Prepare for National Crisis
Following the general national assembly of PAD members on March 10, 2012 which passed a resolution to rally, as appeared in the announcement number 2/2012 under three conditions as follows.
1 Any actions, no matter constitution amendment or law enactment which may lead to alteration of the structure of Royal institution or decrease of His Majesty's Royal authority.
2 Any actions, no matter constitution amendment or law enactment which may lead to amnesty to the convicted Thaksin Shinawatra and the crony.
3 When the situation of the country becomes appropriate for the people to proceed to a major change of the country.
With such three conditions above whenever occur, PAD shall immediately notify the public and organize a major rally. Therefore, no matter the government would, in any way or any formats, fulfill any of the above conditions, PAD confirms that we shall stage the utmost protest.
As for the public and the media's interest in the government's stance which has been advertising to convince Thai people to accept the authority of the International Court of Justice and to be prepared for a defeat on the elaboration of the 1962's verdict of Praviharn temple case, PAD has issued 4 announcements on July 20, 2011 to prove how people have long been struggling and successful, as well as expressing solutions in the announcements: no.3/2011 titled "The people sector has already struggled for the sovereignty and the territory at their best."; no.4/2011 titled "Thai Kingdom's military has not done their part in defending the national sovereignty.", no.5/2011 titled "The proof of failure of Democrat government claiming benefits of MOU2000 and the future lost of territory through accepting the ICJ's jurisdiction".
With such announcements, PAD declared that the disadvantageous temporary protective measures (ordered by ICJ) would certainly indicate future lost of territory since if Thailand plunges to admit the ICJ's authority, ICJ will elaborate the verdict in favour of Cambodia and against Thailand. Likely, ICJ will claim estoppel as Thailand has never denied the French 1:200,000 ratio map which was the basic evidence for judging the Praviharn temple to fall into Cambodian's sovereignty in 1962. This will be the unprecedented territorial lost of Thailand and will enable a successful world heritage listing as well as further territorial lost of 1.8 million rai (2880 sq.km) and energy resources in the gulf of Thailand worth of 5 trillion baht. (0.17 trillion USD).
Because of all long overdue failures of several past governments, it is the last chance of Yingluck Shinawatra's government to keep her words upon interviewed on July 18, 2011 which said that as a Thai, she will carry out the duty to defend the sovereignty. This should be done as follows.
First, the Thai Kingdom's government must utiize the last chance at ICJ's public hearings of Cambodia's request for the court's elaboration on the verdict of 1962's Praviharn's case on Monday April 15 to 19, 2013 at the Peace Palace, the office of the ICJ at the Hague, Netherland, in order that the government of the Kingdom of Thailand would officially declare that she does not recognize the ICJ jurisdiction in elaboration in this case and she will not accept the authority of the ICJ particularly those affect the sovereignty and the integrity of the territory of the Kingdom of Thailand.
Since the Kingdom of Thailand has completely fulfilled the verdict and such deeds have been acknowledged without objection from the Kingdom of Cambodia and members of the UN. Moreover, the Kingdom of Thailand has announced a protest and disagreement against the court's wrongful and unjust verdict and declared a reservation for the future development of the international law. That announcement has never been opposed by any of the members of the UN in addition to the expiration of the Declarations Recognizing the Jurisdiction of the Court as Compulsory since 1962.
Second, the Kingdom of Thailand must not recognize the authority of the ICJ in elaboration on the verdict. The Kingdom of Thailand, then, will not be obligated to the ICJ's temporary protective measures. Thailand must not withdraw the military or border police force from her own territory but must force Cambodian communities out from Thai territory. Obviously, since the establishment of the ICJ, contentious states requested temporary protective measures in 17 cases where ICJ issued 10 cases but not even one state, including USA, abide by them. Therefore, such orders are by no means compulsory. If Thai government complies by withdrawing the military from the area, then she will be the first in the world to follow the temporary protective measures despite that Cambodian communities' intrusion into the territory of the Kingdom of Thailand.
Third, Thai government should restore and develop international relationship particularly and urgently with the United Nations Security Council to ensure that no country will influentially violate our national sovereignty.
Fourth, claiming clause 7 of the United Nations Charter article 2, the Thai government must insist that members of the United Nations do not have the authority to interfere with internal matters and the sovereignty of the Kingdom of Thailand. Also, the government of the Kingdom of Thailand must insist on the 2 (a) and 2 (e) of the Charter of the Association of Southeast Asian Nations which state that ASEAN nations member must abide by and follow the principles of respect to sovereignty, equality, integrity of the territory as well as non-interference of ASEAN nation members' internal affairs.
Fifth, the government of the Kingdom of Thailand must not re-enter the state party of the World Heritage Convention.
Sixth, the Thai government must stop the 7.1-million-baht-hired scholars, employed by the foreign ministry to single-sided propaganda on the state media to convince Thais to comply with giving away the Thai territory to Cambodia, because those scholars favour Cambodia. The government should open up extensive media forum for people to receive information from those who defend the sovereignty and those who are in disagreement with the government's policies.
Seventh, the government must help to as soon as possible free Mr.Weera Somkwamkid and Miss Ratree Pipatanapaiboon who were abducted by Cambodian troops within Thai soil but were incriminated by Abhisit Vejjajiva's government that they were captured in Cambodia.
Therefore, if the government despite of being aware of alternatives, is still ignorant and continues to do public relation for Thai people to accept defeat to unjustice in the ICJ forum, the government will be considered to be a traitor and responsible for this loss of sovereignty and territorial integrity. it will be considered the first and unprecedented in history that the Thai Kingdom loose the territory in the current reign because of the conspiracy among all political parties, involving bureaucrats and army leaders who do not carry out defending the nation according to the constitution. They will be liable to all coming shame.
From above reasons, accordingly, core leaders of the PAD agree to send a representative of PAD to propose a formal demand to PM Yingluck Shinawatra at the government house on Tuesday January 8, 2013 at 10:00.
